GitSec Terms of Service
1. Acceptance of Terms
By accessing or using the GitSec service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
GitSec provides automated backup and restore services for GitHub repositories. Our services include:
- Full repository backup (code, branches, tags).
- Metadata backup (issues, pull requests, wikis).
- Point-in-time restoration capabilities.
3. Account Registration & Security
- You must provide accurate and complete information during the signup process.
- You are responsible for maintaining the security of your account credentials.
- One user account is intended for use by one person. Sharing credentials is prohibited.
4. Payment & Billing
- Subscription: Paid plans are billed on a monthly or annual basis.
- Pricing Changes: We reserve the right to change prices with a 30-day notice.
- Refunds: We offer a 14-day money-back guarantee. If you are not satisfied, contact us within 14 days of your initial purchase for a full refund.
5. User Responsibilities
You represent and warrant that:
- You own or have the necessary rights to the data you back up using GitSec.
- You will comply with our Acceptable Use Policy (AUP).
- You will not use the Service for any illegal activities.
6. Intellectual Property
- GitSec Rights: GitSec retains all ownership and intellectual property rights to the Service and its software.
- Your Data: You retain full ownership of your data (repositories and metadata). You grant GitSec a limited license to access, store, and process your data solely for the purpose of providing the Service.
7. Service Availability & SLA
We aim for 99.9% uptime. While we strive for continuous availability, maintenance windows or unforeseen technical issues may cause temporary downtime. Detailed SLA terms are available for Enterprise plans.
8. Limitation of Liability
To the maximum extent permitted by law, GitSec shall not be liable for any indirect, incidental, special, or consequential damages.
- GitSec's total liability for any claim arising out of these Terms shall not exceed the total amount paid by you in the last 12 months.
9. Termination
- By You: You may cancel your subscription at any time via your Account Settings.
- By Us: GitSec may terminate or suspend your account for violations of these Terms (e.g., non-payment, AUP violations).
- Data Retention: Upon cancellation, your data will be retained for 30 days to allow for recovery, after which it will be permanently deleted.
10. Governing Law
These Terms shall be governed by the laws of the State of California, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes at least 30 days in advance via email or a prominent notice on the dashboard. Continued use of the Service constitutes acceptance of the new Terms.
